Solution Acceptance & IP Protection

Once we have a solution that meets our strict criteria for success based on testing, projected simplicity to produce and implement, we take the first actions to protect our Intellectual Property (IP).

Once a solution clears our strict criteria for success, the pivot from scientific discovery to commercial asset protection is a critical race against time. In biotech and immunology, a brilliant solution is only as valuable as the intellectual property (IP) fortress built around it.
Traditionally, selecting a final candidate and drafting patents was a fragmented process managed by separate legal and scientific teams. Today, AI tools have unified and accelerated this workflow, turning IP protection from a reactive legal step into a proactive, predictive engineering tool.

The Evolution of Solution Selection & IP Protection

Once a solution clears our strict criteria for success, the pivot from scientific discovery to commercial asset protection is a critical race against time.

Traditionally, selecting a final candidate and drafting patents was a fragmented process managed by separate legal and scientific teams.

Today, AI tools have unified and accelerated this workflow, turning IP protection from a reactive legal step into a proactive, predictive engineering tool.

Era / ParadigmHow Solutions Are SelectedHow IP is Captured and ProtectedMajor Limitations
The Manual Era (Pre-2010s)Empirical filtration: Relying on physical assay data, human intuition, and iterative wet-lab testing. Candidates were chosen based on narrow, static benchmarks.Reactive drafting: Scientists handed laboratory notebooks to patent attorneys, who manually searched databases and drafted broad text claims. The “Blind Spot” Risk: Patent filings were slow, leaving a massive window for competitors to file first (“first-to-file” risk) or missing hidden prior art.
The In Silico Era (2010s–Early 2020s)Predictive modeling: Using basic machine learning (ML) classifiers to predict safety, manufacturability, and toxicity profiles before extensive physical testing.Keyword-based searches: Utilizing digital landscape tools to scan existing patent offices globally via keywords and structural chemical searches.Rigid Frameworks: Couldn’t easily predict the patentability of highly complex biological entities (like engineered T-cell receptors) or handle vast text data.
The Agentic Era (Today, 2026)Multi-objective optimization: GenAI models evaluate a molecule simultaneously for biological efficacy, ease of manufacturing, supply chain viability, and patentability score.Generative IP Capture: Automated AI agents ingest lab data, map out the absolute maximum structural boundaries of the invention, and draft hyper-defensible patent applications in hours.Evolving Jurisdictions: Patent offices globally are constantly updating legal rules regarding what constitutes human vs. AI-generated inventorship.

How AI Transforms Solution Selection & IP Capture Today

Modern AI changes the game by treating patent drafting not just as a legal requirement, but as a biological map. Here is how AI tools drive our specific methodology forward:
1. Predictive “Patentability” Screening During Selection
Instead of testing a solution and then checking if it’s unique, AI integrates IP landscape analysis directly into our final selection criteria.
The AI Shift: Advanced platforms concurrently evaluate our final candidate group for biological success criteria (e.g., binding affinity, low toxicity) alongside automated Freedom-to-Operate (FTO) analyses. The AI maps the candidates against billions of global patent claims, identifying hidden legal roadblocks before we spend a single dollar on a specific candidate.
2. Generative Claim Expansion (“Claim Broadening”)
In biotech, if you protect only the exact sequence of an antibody or the precise formulation of a molecule, a competitor can tweak one minor component and bypass your patent.
The AI Shift: Once we accept a solution, generative molecular AI models are used to “stress-test” your invention. The AI systematically mutates the solution in silico to generate thousands of functional variations that achieve the same result. By handing this massive list of functional variants to our patent attorneys, we can claim an entire structural or functional class of therapeutics, effectively preventing competitors from “designing around” our IP.
3. Automated Drafting and Invention Capture
The bridge between a scientist’s lab notebook and a patent attorney’s legal brief has historically been prone to translation errors and delays.

The AI Shift: Specialized scientific AI LLMs act as automated patent assistants. They ingest raw mass spectrometry data, gene-mapping files, and lab protocols to draft highly technical provisional patent applications and independent claims. This slashes the time to file from months to days, ensuring we secure an early “priority date” in first-to-file jurisdictions.
4. Defending Against “Prior Art” Traps
Finding out that an obscure thesis published in another country invalidates a solution late in the game is an expensive nightmare.

The AI Shift:

Modern IP AI tools use semantic, multi-language, and visual-structure searches (rather than just exact keywords). They can read a newly published paper in Chinese, analyze an academic poster image from a minor conference, or read a gene sequence embedded in a massive supplement file, ensuring our solution is genuinely novel globally before we finalize our application.

The shift to continuous monitoring represents a change in how organisations approach compliance. Rather than periodic snapshots of compliance status, businesses are better off with real-time visibility in their security posture. The transformation has been driven by several factors: the increasing volume and velocity of data processing, the sophistication of cyber threats, and the evolution of regulatory expectations towards proactive rather than reactive compliance.

THERE ARE NO MISTAKES, ONLY SOLUTIONS WAITING FOR A PROBLEM.
